Da Vinci Robot

Ryan Bradley is handling the da Vinci Robot litigation. The da Vinci Robot system is developed and marketed by Intuitive Surgical, Inc. which is a large, powerful medical corporation based in California. As has been heavily reported in the media, there have been an increasing number of injuries from da Vinci Robot surgery. Such injuries include burns, damaged vessels or organs, bleeding and in some cases even death. These injuries are sustained by the patients during surgical procedures. After years of injuries, Intuitive warned hospitals in May 2013 that a component used in its da Vinci surgical robot system may be putting patients at risk for burn injuries. According to the company’s urgent notification, some versions of the system’s Hot Shears may be prone to small cracks and may not be visible.

Despite the burn risk, Intuitive Surgical, Inc. has elected not to recall the da Vinci Robot system that is used in hospitals and surgical centers throughout Illinois.

Since 2009, the number of surgeries reported to be using the da Vinci system has increased by more than 50%. At the same time, the number of adverse events reported to the FDA jumped from 24 in 2009 to at least 115 in 2012. The number of informal incident reports sent to the U.S. Food & Drug Administration (FDA) since 2009 include 70 reported deaths.

Some examples in which the robot has been chosen over its alternative procedure, laparoscopic surgery, include:

  • Complete or partial hysterectomies
  • Treatment of uterine fibroids
  • Kidney disorders
  • Prostate removal procedures
  • Throat and kidney cancers
  • Endometriosis
  • Heavy intrauterine bleeding
  • Surgeries to reduce obesity

Much of the appeal in the da Vinci Robot is that it allows doctors to perform surgeries without opening up the patient. Unfortunately, these types of procedures have their own risks. At lease initially, problems and injuries resulting from the surgeries were overlooked or connected with other modes of injury.

Complications or errors that have been referred to in lawsuits and through witness interviews include:

  • Burns
  • Punctured vessels or organs
  • Uterus lacerations
  • Intestinal tearing
  • Excessive bleeding
  • Death

Unfortunately, complications from the surgery may not be evident until days after the procedure is completed, which uses up valuable time which could be used to treat the injury.
